Full-Service Mediation with or without Independent Counsel

The traditional full-service mediation process involves two parties and one mediator. However, both parties may have independent counsel as well. That means they each have an attorney of their choice looking out for their best interests.

Attorney Talitha Davies Wegner is a Certified Mediator who has successfully guided parties through the divorce process to resolution. If Talitha is the mediator, she must remain neutral and cannot represent one side or the other. If there is a different mediator retained in the matter, then Talitha can represent one of the parties.

Both Talitha Wegner and Chloe Wolman have represented clients who are also mediating their matter. Representation is typically on a limited-scope basis. It may include drafting and filing forms, compiling financial disclosures, and reviewing and negotiating agreements.  It is common for a mediator, both parties, and the parties’ attorneys to meet at some point for settlement purposes.
